Terms of Use

1. Agreement

These terms form a contract between you and Timur Gasymov (“the Developer”, “we”, “us”). Contact: support@horavlog.com. By installing or using Hora, you accept these terms. If you do not agree, do not use the app.

If you are a consumer, these terms do not deprive you of the mandatory protection you have under the law of your country of residence.

These terms are provided in English and Russian. If versions differ, the English version prevails so far as the law allows; for consumers this does not override any mandatory rule requiring information in a language you understand.

2. What Hora Is (and Is Not)

Hora is app software: a personal video diary that can optionally connect to a separate server, run by you or an adult member of your family for private, personal use, to share short video messages within that private family group.

We provide the app only. We do not operate the group servers, we do not host or store your videos or messages, and we do not guarantee that any server is available, secure or retained for any period. Features such as an hourly recording slot or a 24-hour retention window are behaviours of the server you connect to, controlled by its owner — not promises by us. Connecting to any server, including an adult family member’s server, is your choice and at your own risk. Hora is intended for personal and family use only; you must not use the app to operate, or connect it to, a public, open-registration or commercial service.

3. Access and Account

Signing in happens on the server you connect to, using a one-time email code or a device secret. Hora does not use Google or any other social login. You are responsible for the accuracy of the information you provide, and for protecting your device, your sign-in credentials and any group invitations. The service is for persons aged 18 or over only; by using it you confirm your age and your capacity to enter into this contract. References to your “family” in these terms mean adult family members; Hora is for people aged 18 or over and is not intended for children.

4. Private Groups

Content you publish is visible to the members of the group you choose. We do not make it public, but no app can technically prevent a group member from screen-recording, copying or re-sharing content. Choose who you invite, and do not upload content if that risk is unacceptable to you.

5. Your Content

You keep all rights in the content you record. Because we do not host or store your content, you do not grant us any licence over it; any hosting, storage or transmission is performed by the server you connect to, under that server owner’s terms. You confirm that you have the rights, consents and lawful grounds needed to record and share your content, including the image and voice of every person shown or heard in it.

6. Acceptable Use — Zero Tolerance for Objectionable Content

There is zero tolerance for objectionable content or abusive behaviour. You must not use Hora to break the law or infringe others’ rights, and you must not create, upload or share content that is illegal or objectionable, including: sexual content involving minors; threats, harassment, bullying, doxxing or hate; terrorism or violent extremism; sexual exploitation or violence; unlawful recording or disclosure of another person’s personal data; fraud, phishing or extortion; the unlawful sale of drugs, weapons or regulated services; infringement of copyright, image rights or privacy; malware, hacking or circumvention of protections; and instructions for dangerous self-harm. You must not interfere with the app’s infrastructure or automate access without permission. You are solely responsible for the content you create and share.

7. Reporting and Moderation

Hora provides a “Report” function on a group’s log and a “Leave group” function. Because the Developer does not host content, a report is sent to the owner of the relevant server, who is the party able to review content and act on it (remove content, restrict access, or remove a user). Server owners are responsible for moderating their servers. The Developer will act, using the means available to it at the app and distribution level, on serious abuse reported to support@horavlog.com, and may restrict or terminate access for a material breach of these terms.

8. Disclaimers and Liability

The app is provided with reasonable care but “as is”. We do not guarantee uninterrupted or error-free operation, compatibility with every device, delivery of notifications, or the availability, security or retention of any server or of your data. Notifications are only a signal, not a source of truth. We are not responsible for the independent acts of users, of server owners, or of third parties such as Apple, Google, Expo or network providers, unless harm results from our own breach of duty.

To the maximum extent permitted by law, we are not liable for indirect or consequential loss, lost profit, or loss of data not caused by our breach. Nothing here excludes or limits liability that cannot lawfully be excluded, including for intentional misconduct, death or personal injury, or your mandatory consumer rights.

9. Indemnity

To the extent permitted by law, you will hold the Developer harmless from third-party claims, damages, losses and reasonable costs arising from: (a) content you record, upload or share, including infringement of intellectual-property, image, voice, data-protection or privacy rights of any person shown or heard; (b) your breach of these terms or of the law; or (c) your misuse of the service. For consumers, this applies only so far as the claim results from your own intentional or negligent conduct and only to the extent permitted by mandatory consumer-protection law.

10. Apple App Store (EULA Terms)

If you obtained Hora from the Apple App Store, you acknowledge that this agreement is between you and the Developer only, and not with Apple, and that Apple is not responsible for the app or its content. The licence granted to you is limited to use of the app on Apple-branded devices you own or control, as permitted by the App Store Terms of Service. The Developer, not Apple, is solely responsible for the app, for any maintenance and support, for any product-liability, legal or intellectual-property claims relating to the app, and for addressing your claims concerning the app. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.

11. Changes and Termination

You may stop using Hora at any time by leaving your groups and uninstalling the app. We may change these terms for an objective reason (security, legal compliance, preventing abuse, fixing errors or developing a feature) with notice here; if a change materially harms you as a consumer, you may stop using the app. We may restrict or terminate access for a material breach, a risk of harm, or a legal requirement, giving a reason where possible.

12. Governing Law

These terms are governed by the law of the Russian Federation. If you are a consumer, you also keep the mandatory rights available to you under the law of your country of residence, and this clause does not deprive you of them. Please contact support@horavlog.com first to resolve any issue; this does not restrict your right to apply to a competent court or authority.
